Limits On Our Liability
If you are buying the products for personal, domestic or household use, then you have the rights and remedies available under the Consumer Guarantees Act 1993 and the following limitation on our liability does not apply.
If you are acquiring the products for the purposes of business, then the guarantees and remedies provided under the Consumer Guarantees Act 1993 are excluded and the provisions of this clause apply.
You use the information, services, products and materials available from this Site at your sole risk. In no circumstances will Army and Outdoors be liable to you - whether in contract or tort or under any other legal principle - for any direct, indirect, special, repetitive, incidental, exemplary or consequential damages, or any damages whatsoever arising out of or in connection with your use, inability to use, or performance of the information, services, products and materials available from this Site.
Disclaimer
While every effort is made to keep the information on this Site current, prices and product availability are subject to change and Army and Outdoors will advise you upon placement of your order if changes have been made during the time since the Site was last updated and your order is posted. You can then either agree to still purchase the products or alternatively we will refund the money you have paid.
Military Surplus Condition and Product Care
Many products sold as military surplus are older, previously issued or have been stored for extended periods. Their age, construction, fibres, specialist coatings and hardware mean that their condition and care requirements may differ from modern clothing. Items may show reasonable signs of service or storage consistent with their product description and condition grade. Where an item is supplied unwashed or in its original storage condition, this will be stated in the product listing.
Before washing, drying, dry-cleaning or otherwise treating an item, please inspect it and follow any care label and product-specific instructions. If no instructions are available or you are unsure, please contact us before cleaning the item. Some vintage or technical materials may be unsuitable for standard household detergents, bleach, fabric softeners, harsh chemicals or high heat.
To the extent permitted by law, Army and Outdoors is not responsible for shrinkage, colour fading, loss of waterproofing or coatings, or other damage caused by inappropriate washing, drying, dry-cleaning, chemical treatment, alteration or failure to follow the relevant care instructions. We do not accept change-of-mind returns after an item has been washed, dried, dry-cleaned, altered or chemically treated. This does not limit any rights or remedies available under the Consumer Guarantees Act 1993 or other applicable law, including where an item was faulty, unsafe or not as described when supplied.
Ordering
Ordering a product is very easy. Just click on a product and add it to your shopping basket. You then need to follow our payment instructions to purchase the products you choose to buy.
Prices
All product prices displayed at the Checkout include GST if shipped to a New Zealand address.
All product prices displayed on the Final Purchase Approval page include shipping, packaging & handling charges.
All orders will be delivered by courier. Different products have different delivery times. Occasionally delivery times may vary depending on product availability and delivery delays.
If your order is not delivered within the time quoted, please email us with your personal and order details, 24 hours a day.
Army and Outdoors will do our best to give you a reason for any delay.
Cancellation By You Prior To Delivery
You acknowledge that Army and Outdoors will incur obligations and costs once you place an order with us. Therefore you may not cancel or vary an order once it has been placed with us unless of course Army and Outdoors advise you that delivery cannot be made due to circumstances beyond our reasonable control.
Events Beyond Our Control
Army and Outdoors will be excused from our obligation to deliver goods within the estimated time if that non-performance is due to events beyond its reasonable control.
Governing Law
Your order and the contract between you and Army and Outdoors is subject to the law of New Zealand and Army and Outdoors submit to the exclusive jurisdiction of the courts of New Zealand. The Vienna Convention on the International Sale of Goods does not apply. If you are not located in New Zealand, Army and Outdoors will not be liable for any breach of foreign legislation, code or directive as a result of you importing any of the products ordered from our Site into your country.
